The terms that apply to using this website. Client work is governed by a separate signed agreement.
Scope
These terms govern your use of computingamerica.com, hardware.computingamerica.com, it.computingamerica.com and cyber.computingamerica.com and nothing else. Any engagement is governed by a separate written agreement: a master services agreement, a statement of work, a managed services agreement, or some combination. Where those conflict with these terms, the signed agreement controls.
The party behind this site and behind those agreements is Hyrax LLC d/b/a Computing America.
No offer, no advice
Nothing on this site is an offer to contract, and nothing here is legal, financial, security or compliance advice. Service descriptions are informational, not binding quotes. Cost ranges, durations and outcome figures are illustrative and depend entirely on the specifics of an engagement.
The first call is free and is general guidance only. It does not create a services relationship, and neither of us is obliged to proceed after it.
Case studies and figures
Every case study on this site is a verified engagement: it describes real work, client names and identifying details are withheld under confidentiality agreements unless that client has agreed to be named, and its metrics reflect that client’s measured results under that client’s conditions. If we ever publish a narrative written to the shape of our work rather than drawn from a specific engagement, it will say so on its own page, in the summary of the work index, and in the machine-readable versions of both.
Neither kind is a prediction of what any other organization will achieve. Where you need substantiation before making a decision, ask us and we will tell you exactly what is behind a given figure.
Intellectual property
The content, design and code of this site belong to Hyrax LLC. You may read, link to and quote it with attribution. You may not republish it wholesale or present it as your own.
Who owns what we build for you is a different question, and it is answered in the engagement agreement rather than here. The short version we publish elsewhere on this site — that you own the code — is a description of our standard terms, not a substitute for them.
Acceptable use
Do not attempt to disrupt the site, access areas of it you have not been granted access to, scrape it at a rate that degrades service for others, or submit false information through the contact form. Separate rules apply to clients using services we operate; see the acceptable use policy.
Do not probe this site for vulnerabilities without written authorization. If you believe you have found a security issue, tell us at info@computingamerica.com and we will respond. We do not pursue people who report a genuine issue to us in good faith and give us a reasonable chance to fix it before disclosing it.
Availability and liability
This site is provided as-is and as-available, without warranties of any kind to the extent the law permits us to disclaim them. We do not warrant uninterrupted availability.
To the extent permitted by law, Hyrax LLC is not liable for any indirect, incidental, special or consequential loss arising from your use of this site, and our total liability arising from the site is limited to the amount you paid to access it, which is nothing. None of this limits liability that cannot lawfully be limited. Liability arising from paid work is addressed in the engagement agreement, not here.
Indemnity
You agree to indemnify Hyrax LLC against claims, losses and reasonable costs arising from your unlawful use of this site or your breach of these terms.
Links out
Where we link to someone else’s site we are pointing at their work, not adopting it. We do not control what is on the other end and are not responsible for it.
Changes to these terms
We may revise these terms. The version on this page, under the effective date at the top, is the one that applies to your use of the site. Continuing to use the site after a change means the revised terms apply.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and we submit to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.
